Terms and Conditions of Use and Privacy Policy

Courage Fitness Durham (“CFD,” “we,” “us,” or “our”) operates https://couragefitnessdurham.com and related services (the “Website”). We are owned and operated by Durham Strength and Conditioning LLC, located at 410 W Geer St, Durham, NC 27701.

This Agreement governs your access to and use of the Website, including any forms, booking tools, or content. By using the Website, you agree to these Terms of Use and Privacy Policy. If you do not agree, do not use the Website.

We may update this Agreement. Continued use after posting updates constitutes acceptance.

SECTION 1 – TERMS OF USE

1.1 Eligibility You must be at least 18 years old (or the age of majority where you reside). For children under 18 using kids’ fitness programs, a parent or guardian must supervise and consent.

1.2 Intellectual Property All Website content (text, images, client journey graphics, videos, programs, logos, etc.) is owned by CFD or licensed to us and protected by U.S. and international intellectual property laws. You receive a limited, revocable, non-exclusive, non-transferable license for personal, non-commercial use only.

1.3 User Conduct You agree not to: post harmful, defamatory, or infringing content; attempt unauthorized access; submit false information; or use the site unlawfully.

1.4 Fitness & Health Disclaimers All content is for general educational purposes. It is not medical, nutritional, or therapeutic advice. Consult a physician before beginning any program, especially with pain, mobility issues, or medical conditions.

Participation involves inherent risks of injury. You assume all risks. CFD does not guarantee results — outcomes depend on individual effort and consistency.

1.5 Limitation of Liability To the maximum extent permitted by law, CFD and its affiliates shall not be liable for indirect, incidental, consequential, or punitive damages. If liable, total liability is capped at the greater of $500 or amounts you paid us in the prior six months.

1.6 Indemnification You agree to indemnify CFD against claims arising from your breach or use of the Website.

1.7 Dispute Resolution Mandatory Binding Arbitration & Class Action Waiver Disputes shall be resolved by final, binding arbitration under AAA rules in Durham, North Carolina. You waive jury trials and class actions. Small claims and IP/injunctive relief exceptions apply. Governing law: North Carolina.

1.8 Governing Law & Venue North Carolina law governs. Non-arbitrable disputes go exclusively to Durham County courts.

1.9 Severability Invalid provisions do not affect the rest.

SECTION 2 – PRIVACY POLICY

2.1 Introduction & Scope We respect your privacy and are committed to protecting your personal information, especially sensitive health and fitness data. This Policy explains what we collect, how we use it, and your rights. It applies to the Website and interactions with our services.

We use Mindbody Online for membership management and billing, and Lead Action (via SiteFit) for CRM and website operations. These providers have their own privacy practices — see their policies for details.

2.2 Information We Collect

  • Contact & Account: Name, email, phone, address, DOB.
  • Sensitive Health & Fitness Data: Pain/limitations, mobility assessments, goals, measurements, nutrition/lifestyle notes, progress photos/videos (voluntarily shared).
  • Usage & Technical: IP address, device info, browsing activity, cookies/analytics.
  • Payment: Processed securely via Mindbody (we do not store full card details).
  • Kids/Family: Limited data for children’s programs with parental consent.

2.3 How We Collect Directly from you (forms, discovery calls, assessments), automatically (cookies, pixels), and from third parties (Mindbody, Lead Action integrations).

2.4 Purposes & Legal Basis We process data to: deliver personalized coaching/programs, manage memberships, communicate, improve services, market (with consent), and comply with law. For sensitive data, we rely on explicit consent where required.

2.5 Sharing & Disclosure We do not sell personal information. We share with:

  • Service Providers: Mindbody Online (billing/membership), Lead Action/SiteFit (CRM/website), analytics, email, payment processors.
  • Legal obligations, safety, or business transfers.

2.6 Cookies & Tracking Technologies We use essential, analytics, and functional cookies. You will see a consent banner on first visit. Manage preferences there. We honor Global Privacy Control signals where applicable.

2.7 Your Privacy Rights (2026) You may have rights to: access, correct, delete, opt-out of sale/sharing/targeted advertising, limit sensitive data processing, and portability/appeal.

  • California Residents (CCPA/CPRA): Submit requests to [email protected].
  • North Carolina & Other States: We honor applicable rights under NC PDPA (if triggered), Virginia, Colorado, etc.
  • Sensitive Health Data (e.g., under Washington My Health My Data Act analogs): We obtain affirmative consent for collection/processing/sharing beyond core services.

Submit requests via email. We respond within legal timelines (usually 45 days).

2.8 Data Security & Breach Notification We use reasonable safeguards (administrative, technical, physical). In case of a breach, we will notify affected individuals and authorities as required by NC law (within 45 days) and other applicable rules.

2.9 Data Retention We keep data as long as needed for the purposes disclosed or required by law (e.g., 7 years for financial records; fitness assessments for the duration of your active membership + 2 years).

2.10 Children’s Privacy (COPPA) We do not knowingly collect data from children under 13 without verifiable parental consent. Kids’ programs require guardian involvement.

2.11 International Transfers Data may be processed/stored in the U.S. We use appropriate safeguards.

2.12 Automated Decision-Making We do not currently use automated decision-making with significant legal effects, but if we do (e.g., AI program suggestions), you will have opt-out/appeal rights.

2.13 Changes to This Policy Material changes will be posted with a new date and, where feasible, notified via email or Website notice.
